Welcome to Oclef, Inc. (“Oclef,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website (www.oclef.com), mobile application, and all related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
The Service is available to individuals who are at least 18 years of age or who are using the Service under the supervision and consent of a parent or legal guardian. By creating an account or enrolling a student, the parent or legal guardian agrees to these Terms on behalf of themselves and the enrolled student.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update your information as needed. Notify us immediately at support@oclef.com if you suspect unauthorized use of your account.
3. Services and Enrollment
Oclef provides online and in-person music education services, including but not limited to piano lessons, group programs, recitals, concerts, and related events. Enrollment in any program is subject to availability and Oclef’s acceptance. We reserve the right to modify, suspend, or discontinue any program or service at any time with reasonable notice.
4. Payments and Billing
By enrolling in a paid program, you agree to pay all applicable fees as described at the time of enrollment. Fees are billed on a recurring monthly basis unless otherwise specified. You authorize Oclef to charge your designated payment method for all fees incurred.
- Late Payments: Accounts with overdue balances may be subject to suspension of services.
- Price Changes: We may adjust pricing with at least 30 days’ written notice.
5. Cancellation and Refund Policy
You may cancel your enrollment at any time by providing written notice to support@oclef.com. Cancellations take effect at the end of the current billing cycle. Prepaid fees for the current billing period are non-refundable. Oclef reserves the right to cancel enrollment at its discretion with reasonable notice.
6. Code of Conduct
All students, parents, and guardians are expected to treat Oclef staff, instructors, and fellow students with respect. Oclef reserves the right to terminate enrollment for behavior that is disruptive, abusive, or otherwise inconsistent with a positive learning environment.
7. Intellectual Property
All content on the Service — including but not limited to text, graphics, logos, images, audio, video, lesson materials, and software — is the property of Oclef, Inc. or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
8. User Content
By submitting any content through the Service (such as photos, videos, recordings, or testimonials), you grant Oclef a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for promotional and educational purposes. You represent that you have the right to grant this license for any content you submit.
9. Assumption of Risk
Participation in Oclef programs, events, and activities — whether online or in-person — is voluntary. You acknowledge that participation may involve inherent risks and agree to assume those risks. Parents and guardians assume responsibility for the safety and supervision of minor students during and around Oclef events and activities.
10. Limitation of Liability
To the maximum extent permitted by law, Oclef, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the total fees paid by you to Oclef in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. Oclef makes no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific educational outcomes.
12. Indemnification
You agree to indemnify and hold harmless Oclef, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
13. Third-Party Links and Services
The Service may contain links to third-party websites or services. Oclef is not responsible for the content, privacy practices, or availability of any third-party sites. Your use of third-party services is at your own risk.
14. Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or by posting a notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the courts located in Santa Clara County, California.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oclef, Inc. regarding your use of the Service.
